These Terms and Conditions (“Terms”) govern the use of services available on or through Mechanic Dekho’s website and mobile application (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. SERVICES
a) The Platform enables users to schedule and arrange various services, including AC and fridge repair, plumbing, carpentry, painting, automobile services, electrical work, photography, tailoring, construction, laundry, cleaning, and priest services, with independent third-party service providers (“Service Professionals”). Our role is limited to facilitating payments to Service Professionals and providing a platform for service booking.
b) The services rendered by Service Professionals are referred to as “Pro Services.” Mechanic Dekho does not provide these Pro Services and is not responsible for their quality, safety, or legality. Service Professionals are independent entities and not employees, agents, or partners of Mechanic Dekho.
c) The Platform is for personal and non-commercial use unless otherwise agreed upon in a separate contract. Services are primarily intended for use within our operating regions. If you use the Services outside this jurisdiction, you acknowledge and accept the applicable local terms.
d) As part of our Services, we may send you communications, including SMS, email, or WhatsApp messages regarding your bookings, transactions, or promotions. You may opt out, but this may affect your ability to use certain Services.
e) In some cases, we may require identification proof before providing the Services. Failure to provide required identification may result in service denial.
2. USER CONTENT
a) Users may post comments, reviews, and feedback on the Platform (“User Content”). By submitting User Content, you grant Mechanic Dekho a non-exclusive, royalty-free, worldwide license to use, modify, and distribute the content for operational, advertising, or legal purposes.
b) We may request reviews from customers and service providers for quality control. False or misleading reviews may result in account suspension.
c) Mechanic Dekho reserves the right to remove any User Content deemed inappropriate, misleading, or in violation of these Terms without prior notice.
3. CONSENT TO USE DATA
a) We collect and process personal data as outlined in our Privacy Policy. By using our Services, you consent to this data collection and processing.
b) We may share user data with affiliates and third-party service providers for service facilitation, analytics, and customer experience enhancement.
c) If required by law enforcement or government agencies, we may disclose your data in compliance with applicable legal requirements.
4. BOOKINGS
a) The Platform allows users to book services at available time slots. We will make reasonable efforts to match users with Service Professionals, but availability is not guaranteed.
b) Once a booking is confirmed, we will notify you via SMS, email, or push notification. Payment terms will be specified at the time of booking.
c) Cancellations before confirmation will not be charged. If canceled after confirmation, a cancellation fee may apply as per our cancellation policy.
d) In case a selected Service Professional is unavailable, we will offer a substitute from our registered professionals.
5. PRICING, FEES, AND PAYMENT TERMS
a) Service charges and additional fees will be specified at the time of booking. Fees may include convenience charges, warranty fees, or other applicable costs.
b) Payments may be made via credit card, debit card, UPI, net banking, wallets, or cash on completion. Available payment methods may vary.
c) Charges and fees are final and non-refundable unless stated otherwise by Mechanic Dekho or required by law.
d) Prices may vary based on location, demand, and service complexity. Users will be informed of pricing before booking.
e) Taxes are included in the final billing amount.
6. CUSTOMER CONDUCT
a) Users must not discriminate against Service Professionals based on race, religion, nationality, disability, gender, or other protected characteristics.
b) Users must provide a safe and clean environment for Service Professionals to perform their duties. If a Service Professional feels unsafe or experiences disrespectful behavior, they may refuse service.
c) Misconduct toward Service Professionals, including abusive language, threats, or unsafe conditions, may result in service denial and account suspension.
d) If a Service Professional behaves inappropriately, users must report the incident within 48 hours to Mechanic Dekho at Contact@mechanicdekho.com.
7. LIABILITY DISCLAIMER
a) Mechanic Dekho is not responsible for the quality, safety, legality, or performance of services rendered by independent Service Professionals.
b) We do not guarantee specific results from Pro Services. Any disputes regarding service quality must be resolved between the user and the Service Professional.
c) To the extent permitted by law, Mechanic Dekho is not liable for indirect, incidental, or consequential damages resulting from the use of our Platform.
8. CHANGES TO TERMS We reserve the right to modify these Terms at any time. Changes will be effective upon posting on the Platform. 9. THIRD PARTY SERVICES
(a) The Platform may include services, content, documents, and information owned by, licensed to, or otherwise made available by a third party (“Third Party Services”) and contain links to Third Party Services. You understand and acknowledge that Third Party Services are the sole responsibility of the third party that created or provided them and that the use of such Third Party Services is solely at your own risk.
(b) We make no representations and exclude all warranties and liabilities arising out of or pertaining to such Third Party Services, including their accuracy or completeness. Should you avail a Third Party Service, you shall be governed and bound by the terms and conditions and privacy policy of the third parties providing the Third Party Services. Further, all intellectual property rights in and to Third Party Services are the property of the respective third parties.
10.YOUR RESPONSIBILITIES
(a) You represent and warrant that all information that you provide in relation to the Services and Pro Services is complete, true, and correct on the date of agreeing to these Terms and shall continue to be complete, true, and correct while you avail the Services and/or the Pro Services. Should any information that you provide change during the existence of these Terms, you undertake to immediately bring such change to our notice. We do not accept any responsibility or liability for any loss or damage that you may suffer or incur if any information, documentation, material, or data provided to avail the Services is incorrect, incomplete, inaccurate, or misleading or if you fail to disclose any material fact.
(b) You shall extend full cooperation to us in our defense of any proceedings that may be initiated against us due to a breach of your obligations or covenants under these Terms.
(c) In respect of the User Content, you represent and warrant that:
(i) You own all intellectual property rights (or have obtained all necessary permissions) to provide User Content and to grant the licenses under these Terms;
(ii) You are solely responsible for all activities that occur on or through your account on the Platform and all User Content;
(iii) The User Content does not violate any of your obligations or responsibilities under other agreements;
(iv) The User Content does not violate, infringe, or misappropriate any intellectual property right or other proprietary right including the right of publicity or privacy of any person or entity;
(v) The User Content does not contain any viruses, corrupted data, or other harmful, disruptive, or destructive files or content;\(vi) The User Content does not violate any third-party rights; and
(vii) The User Content does not include any content that is defamatory, harmful, blasphemous, discriminatory, objectionable, or in violation of any law.
(d) You shall not use the Services in any manner except as expressly permitted in these Terms. Without limiting the generality of the preceding sentence, you shall not:
i) Infringe any proprietary rights, including copyrights, patents, trademarks, or trade secrets;
(ii) Copy, distribute, modify, reproduce, or transmit the Services except as permitted;
(iii) Use the Services to transmit malicious code or any harmful software;
(iv) Use automated tools to access the Services without authorization;
(v) Engage in systematic content retrieval to compile a database;
(vi) Use the Services unlawfully, fraudulently, or maliciously;
(vii) Decompile, reverse engineer, or disassemble the Services;
(viii) Link to, mirror, or frame any part of the Services;
(ix) Violate applicable laws in any manner.
(e) You warrant that you shall not engage in any activity that interferes with or disrupts the Services.
(f) You shall not attempt to gain unauthorized access to any portion of the Services, systems, or networks connected to the Services.
(g) You shall not solicit, attempt to influence, or engage a Service Professional outside of the Platform to avoid booking through the Platform.
11. OUR INTELLECTUAL PROPERTY
(a) All rights, titles, and interest in and to the Services, including all intellectual property rights, are owned by or otherwise licensed to us. Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services as per these Terms.
(b) We may request feedback on the Services, and we may freely use and exploit such feedback without any restriction or compensation.
(c) Except as stated in these Terms, no rights in our intellectual property or that of any third party are granted to you. TERM AND TERMINATION (a) These Terms remain effective unless terminated.
(b) We may terminate your access immediately if you breach these Terms, violate laws, or for legitimate business reasons.
(c) You may terminate these Terms at any time by sending notice to us.
(d) Upon termination:
(i) Your Account will expire;
(ii) Access to Services will be restricted;
(iii) Certain provisions will survive termination.
12. DISCLAIMERS AND WARRANTIES
(a) The Services are provided “as is” without warranties of any kind, express or implied.
(b) We do not guarantee that the Services will meet your requirements or expectations.
(c) Pricing errors may occur, and we are not liable for such inaccuracies.
(d) We merely facilitate connections between users and Service Professionals and are not liable for their performance.
(e) Receiving services from Service Professionals independently is solely at your own risk.
(f) We do not guarantee the reliability or quality of Service Professionals.
(g) You assume full responsibility for your use of the Services.
(h) We will maintain a complaints management framework as per applicable laws.
(i) We disclaim liability for:
(i) Your use of or inability to use the Services;
(ii) Service interruptions, defects, or delays;
(iii) Loss of data or content;
(iv) Any indirect, incidental, or consequential damages.
(j) Our liability is limited to the commission we receive for a booking, up to INR 10,000. INDEMNITY You shall indemnify us against claims, liabilities, and costs arising from your use of the Services, violation of these Terms, or any third-party claims arising from your actions.
